P2P技术下网络版权许可模式初探

Preliminary Study on Licensing Models of Internet Copyright under P2P Technology

摘要：本文将从版权的法源出发，引出P2P技术的发展给网络版权制度带来的挑战，剖析传统法律解决模式的弊端，并对当前中国的三种主流网络版权许可模式做出大致的梳理，由此探讨其中的法律、架构、市场和准则这四种规制要素之间的张力，最终针对中国现状，回归中国网络版权许可模式的思考。

ABSTRACT: This article starts with the origin of copyright and introduces the challenge of Internet copyright system, which brought by the development of P2P technology. Then it discloses the disadvantages of traditional legal solution and analyses three leading licensing models of Internet copyright in China. And it discusses the tension among four constraints: law, architecture, market and norms. Finally, in the context of the existing state of China, it considers licensing model of Internet copyright in China.
