从华南虎事件看电子图像证据

――网络公共事件引发的刑事证据思考

摘要：在日常生活和刑事侦查、刑事审判中，电子形式的图像已经成为主流。华南虎事件可以说是电子图像在公共视野中首次成为事实焦点的标志性事件。电子图像的电子属性与网络空间的电子属性重合，网络公共领域的迅速发展，使网络能够在这起事件中起关键作用。而在诉讼中，应对这种与传统图像证据截然不同的新兴证据形态，需要从证据规则、证明过程等角度进行新的探索。

Abstract:Digital Images now dominate criminal investigation ,courtroom and daily life.As Digital Images makes its way into the courtroom, it is important to ensure that the current principles of rule about admissibility and weight are not lost in the embrace of new technology. We should adopt new evidence rule and authenticate procedure with the emerging form of evidence which is distinct from tranditional photograph in criminal investigation and courtroom.
