著作权保护的另一种选择

           ——浅析CC许可协议

 摘要

随着数字时代的到来，知识经济、网络经济已经成为不可忽视的经济增长点。现有的技术使得知识的获取方式变得更为快捷，更富选择性。然而，我们却不无忧心地看到：虽然在绝对数量上，“知识爆炸”是不争的事实，但是在相对概念上，我们可以自由获得的知识却日益减少。在知识领域的新时代“圈地运动”正在兴起。与之相对应的，为公众争取正当权益的活动也随之开展。开源软件（OSS）运动开启了“自由化”的风潮，而在传统的著作权领域，2001年在美国成立的Creative Commons组织（以下简称CC）则试图通过发布类似开源软件运动中的GPL许可证的形式，利用格式化的协议书为权利人“保留一些权利”，从而在一定程度上使得作品的使用趋于灵活化和自由化。采纳CC组织提供的这些协议（以下简称CC许可协议），是否能成为著作权保护的一种行之有效的新型方式；在知识产权逐渐成为一种国家战略考量因素的今天，CC协议的发展的空间又将如何？本文将从对CC许可协议的概述入手，分析其存在的利弊，以及面临的一些问题。

Abstract：

Confronting with the digital era, knowledge-based economy, the network economy has become an important way for economic growth. The existing technology allows access to the knowledge become more efficient and more selective. However, while ‘knowledge explosion’ is an indisputable fact, the knowledge we get for free is increasingly reduced relatively. Corresponding, campaigns of fighting for legitimate rights and interests of the public have been carried out. Open Source Software (OSS) movement brings out the trend of ‘liberalization’, and in the traditional areas of copyright, the Creative Commons Organization (hereinafter referred to CC) is trying to make the use of the works more flexible via the fixed agreement (hereinafter referred to CC license agreement). To a certain extent, these agreements provide an effective protection for copyright and make ‘some rights reserved’ become possible.

Sine IPR has been a part of the national strategic considerations today, will CC agreements have a long way to go in this environment? This paper will start with an overview on the CC license agreements, and then the pros and cons of the agreement and also some problems itself facing with.
